1.                   Forms of Payment

You (“Tour Participant”) may make payment by Visa, MasterCard, check or cash. If your check or electronic debit is returned from your bank for any reason a $25 processing fee will be added to your account balance; and all future payments will need to be made by credit card or certified funds.

2.                   Rates

Prices are based on double occupancy.  (For solo travelers, a single supplement may be available.)  Prices are for land only , and do not include international airfare to or from the US.  You are responsible for making all domestic and/or international air travel arrangements.   We recommend that you do not purchase tickets with high penalty charges for changes.  On-tour transportation is included as indicated on each tour program. Land only rates are guaranteed upon receipt of deposit. Printed rates are subject to change without notice.

We are pleased to handle booking international air for you at an additional cost. If you purchase international airfare, airline taxes, fuel surcharges and government-imposed fees are included and your fare is guaranteed upon receipt of payment. For information about the free baggage allowance and applicable fees for the first and second checked bag and carry-on, please visit the website of your airline. Seat assignments are not available on all airlines and are subject to change without notice. Flight schedules are subject to change without notice.

3.                   Holiday Rates and Programs

Trade fair periods, holidays and festivals may carry additional surcharges, payment requirements and cancellation penalties. During holidays or special events, sites such as museums, restaurants and shopping may be limited or not available.

4.                   Transfers

Transfers are included as indicated.

5.                   Mandatory Guest Information

The Transportation Security Administration requires all passengers to provide their name exactly as it appears on their passport, their date of birth and gender when making airline reservations. This information will also be requested at the time of reservation in order to secure your booking.  In addition, your passport number and its date and place of issue are required by transportation companies in order to for you to travel.  Your trip confirmation includes a Mandatory Guest Information form to make it easy for you to provide this information to us.

Names on your reservation must match the first and last name listed on your passport. Your passport must be valid for six months after your return to the U.S.

6.                   Deposit/Payments

A deposit is due within 3 days of booking to secure your reservation. Please have credit card information, along with home address, and telephone number at time of booking. Reservations made within final payment periods require full payment and passport information at the time of booking. The total tour program price is $2,388.00 per person, based on double occupancy, and payments are due as outlined below:  

Initial Deposit:           $500.00 per person within 3 days of booking. 

First Payment:           $600.00 per person due on January 3, 2017.

Second Payment:      $600.00 per person due on February 15, 2017.

Third Payment           $600.00 per person due on March 15, 2017.

Final Payment Due:   Balance of $298.00 per person due on May 1, 2017.

 7.                  Changes to Reservations

After any payment has been made a minimum $150 fee will be charged for any change made to hotels, sightseeing, ground or air transportation. Changes are considered cancelled services and additional cancellation penalties may apply. Changes are subject to additional airline or hotel charges should the original rates no longer be available for your revised travel dates. Revisions to air tickets are subject to the airline fare rules, change fees and cancellation policies. Changes from double occupancy to single occupancy will incur a single supplement.

8.                  Cancellations

Cancellations are subject to the following per person fees:

• More than 120 days prior to departure: $500 cancellation penalty

• 120-90 days prior to departure: 50% of tour program price

• Within 90 days of departure: 100% of the tour program price

We reserve the right to cancel reservations that are not paid in full at any time after final payment is due, in which case, cancellation charges will apply.  Program rates state prices per person and are based on double occupancy.  “Other Items” that are not part of our program price will be billed as separate items on your invoice.  Surcharges, port charges, taxes, or fees that go into effect or increase prior to the payment in full of your invoice will be added to you invoice.

If you are a no-show, if you cancel your trip after the departure date, or if you leave a trip already in progress, you will not receive any refund for any unused portion of your trip.

We reserve the right to cancel or reschedule any vacation departure for any reason, including insufficient participants. If a vacation is canceled due to non-participation, GoGayTours (the “Operator”)  will refund the amount we have received from our guests.  Operator cannot assume responsibility for any additional costs or any fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through the Operator.

9.                   Refunds

All requests for refunds will be considered promptly, but they must be in writing and received within 30 days of the return date of the tour. There is no refund for unused services or unused portions of your trip.   You may independently purchase Travel Insurance through various third parties to protect your travel investment.

 10.               Changes to Our Programs

We will make every effort to operate all programs as disclosed in the trip literature.  However, circumstances beyond our control may arise which would require an adjustment to the tour, its inclusions or the staff accompanying the trip. We will do all that is possible to avoid such changes but we must reserve the right to make such modifications. Modes of transportation and itinerary routings may change based on the number of passengers on a departure. More than one trip leader or host may accompany you on your guided itinerary. Problems beyond our control (such as civil unrest or acts of nature) may force a change in itinerary.

11.               Tour Documents

Confirmations are electronically mailed approximately 30 days prior to departure for all tours. Documents for all passengers cannot be released until full payment and the Mandatory Guest Information form have been received.  All other tickets, vouchers, maps, etc. will be distributed during the tour program.

12.               Hotels

We must reserve the right to substitute hotels if absolutely necessary. Please note that it is standard policy that hotel rooms are not available for check-in before 3 p.m.

13.               Gratuities

Gratuities for the trip leader, local guides, drivers, and hotel staff are not included unless indicated and are at the discretion of the individual traveler.

14.               Smoking Policy

There is a no-smoking policy on all of our transportation, and in most cases, inside our preferred hotels.

15.               Baggage

Due to the space limitations on bus transfers, you will be restricted to one suitcase and one carry-on bag per person. This is to ensure that we have room for everyone’s luggage. We ask that you abide by this limit to avoid inconveniencing your fellow travelers and prevent additional airlines luggage fees (which are your responsibility). Most airlines now charge to check more than one suitcase per person for flights to Europe and other international flights.

16.               Many Sites Around the World Require Careful Walking and Alertness

Sightseeing, either guided or “on your own,” requires walking over uneven stones and unpaved surfaces, climbing steep stairs and paths that may have no railings, and exploring when weather conditions are wet. Travelers who choose to travel with us assume all responsibility for their personal safety, whether guided or during free time. Activities, lodges, camps and cruise ships in natural settings may require a signed liability waiver.

17.               Medical Issues

You must advise Operator in writing, at or prior to booking, of any physical, emotional or mental condition which (a) may affect your ability to fully participate in the trip; (b) may require professional attention during the trip; or (c) may require the use of special equipment. If any such condition arises after the trip is booked, you must advise Operator in writing immediately.

Operator reserves the right to decline or cancel your reservation, or to remove you from a trip in progress, if Operator reasonably determines your condition would adversely affect the health, safety, or enjoyment of you or of other participants. If Operator removes you from a trip in progress pursuant to this paragraph, you will not be entitled to any refund of your trip price and Operator shall have no further liability.

Most Operator trips are not wheelchair or motorized scooter accessible, as wheelchair or motorized scooter assistance or accessibility in international destinations cannot be guaranteed. On international trips, Operator cannot accommodate motorized scooters of any kind, accommodate women past their sixth month of pregnancy and cannot accommodate service animals.

If you have a condition as contemplated herein, you travel at your own risk. Operator is not liable for any injuries or damages you may suffer relating to such a condition, including without limitation loss of special equipment, lack of assistance with or accommodation of special needs, and unavailability of medical assistance or treatment.

Operator is not responsible for the costs of any medical treatment you may require during the trip. Under no circumstances is Operator responsible for the quality of medical care, or lack thereof, you may receive while on the trip.

18.               Photographs and Video

Operator reserves the right to take photographs and video during your trip. By traveling with Operator, you grant to Operator the absolute and irrevocable right and unrestricted permission to use and publish your image, or likeness, without compensation, for commercial, advertising, editorial, or any other purpose; and in any manner and medium, whether now known or hereafter devised; and to alter and composite the same without restriction and without your inspection or approval. You hereby release and discharge Operator and its affiliates, officers and employees from and against any and all claims, liabilities, costs, damages and expenses of any kind arising out of or relating to the use by Operator of your image or likeness. If you prefer that your image or likeness not be used, you must advise Operator in writing, no later than 30 days prior to your departure date.

Photographs and video of your trip may be submitted to Operator by you or by third parties such as (but not limited to) other travelers, trip leaders, crew, or staff members. By submitting such photographs or video, the party making the submission is representing and warranting (a.) that the photo is their original work created solely by themselves and does not infringe the intellectual property rights of any party; (b) that they have obtained any and all necessary releases from subjects depicted in said original work; (c.) that they grant to Operator and its affiliates a worldwide, royalty-free, perpetual, transferable, irrevocable, non-exclusive and fully sub-licensable right and license to use, in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all commercial or other uses thereof, including without limitation, reproducing, editing, modifying, adapting, publishing, displaying publicly, creating derivative works from, incorporating into other works or modifying the photo and (d.) that they hereby release and discharge Operator and its affiliates, officers and employees from and against any and all claims, liabilities, costs, damages and expenses of any kind arising out of or relating to the use by Operator of any photo submitted.

19.               Responsibility

Operator packages and operates these programs solely as an independent contractor. The tour services described in this brochure, including without limitation transportation, lodging, and sightseeing, are provided by the carrier, hoteliers, and other suppliers that are independent contractors and not agents for, employees, partners, or joint ventures of the Operator. The Operator issues tickets, vouchers, and other travel documents for such services merely as an agent for the companies that furnish such services. Such tickets, vouchers, and other travel documents are subject to all terms and conditions of the respective suppliers (some of them may limit or exclude the supplier’s liability). The Operator is not responsible for any loss of or damage to property or death or injury to persons, resulting from any act or omission of any supplier providing any tour service or any other person or entity or caused by strike, war, weather, quarantine, sickness, government restriction or regulation, or any other cause beyond its reasonable control, including supplier’s decision to withdraw and/or cancel a tour for any reason.  The Operator is not responsible for any loss or damage to property or death or injury to persons, resulting from any act or omission of Tour Participant, including but not limited to, the use of drugs or alcohol, regardless of the legality or illegality of any such substances.

The Tour Participant expressly waives all rights, which he or she may have against the Operator in connection with the foregoing, and release Operator from any and all liability, claims, actions, or rights of action, which are related to, arise out of, or are in any way connected with Tour Participant’s participation in any of these programs, including but not limited to, the negligent acts or omissions, or breach of contract of the Operator, for any injury, death, illness or disease, and bodily or property damage.  Under no circumstances is the Operator to be construed as a carrier under contract for safe carriage of the passenger or his or her baggage and belongings. The Operator reserves the right to remove a client from a tour and provide a full refund for unused services.

20.               Disputes

All matters concerning these tour programs and services shall be governed by, and administered and interpreted according to the laws of the State of California (without regard to conflicts of laws principles). 

In no event shall Operator be liable for, and Tour Participant expressly waives and right to, any indirect, consequential, punitive, multiple, incidental, special or exemplary damages, however caused, and whether in contract, tort or under any other theory of liability, and regardless of whether Operator has been advised of the possibility of such damages.  Notwithstanding the foregoing, Operator’s liability for damages hereunder shall in no event exceed the amount actually paid by you to Operator for the trip giving rise to the claim. The foregoing limitation of liability shall not apply to liability for death or personal injury to the extent applicable law prohibits such limitation.  Any legal proceeding against the Operator must be commenced within one year following the date of tour completion.

Any unresolved dispute or controversy arising under or in connection with the services provided by the Operator shall be settled exclusively by arbitration, conducted before the American Arbitration Association in Los Angeles, California, in accordance with the rules of that body then in effect. In addition, the arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to a claim that all or any part of this contract is void or voidable. The arbitrator shall not have the authority to add to, detract from, or modify any provision hereof nor to award punitive damages to any injured party. A decision by the arbitrator shall be final and binding. Judgment may be entered on the arbitrator’s award in any court having jurisdiction. Each party shall be responsible for the respective fees and expenses of their legal representation and the costs of arbitration shall be shared equally.

21.               Visa & Passport Information

A valid passport is required for U.S. citizens traveling on our international trips.  You will be notified if your destination requires a visa for U.S. citizens.  All passports must contain at least four blank pages and must be valid for six months after the completion of your trip.  For more information go to our Passports & Visas page.  Non- U.S. citizens should contact the appropriate consular office for entry requirements pertaining to their trip, as Operator is not responsible for providing you with this information or documentation.
